IFTA Penalties

IFTA For Beginners


IFTA is the International Fuel Tax Agreement between the 48 continental United States and 10 Canadian Provinces. It was put in place to simplify the reporting of fuel usage by qualifying motor vehicles that travel between two or more jurisdictions (states).

You are required to file this return four times a year with your base jurisdiction, which is the state where your vehicle is registered. By complying with this law you will receive an IFTA license and two decals to place on the driver’s side door of your truck.

1st Quarter - April 30th
2nd Quarter - July 31
3rd Quarter - October 31st

Total miles traveled by the IFTA licensee’s qualifies motor vehicles per jurisdiction. including taxable and nontaxable, IFTA and non-IFTA, and trip permit miles.

We have to admit that it’s been one eventful quarter. The hot summer days turned into fall and many IFTA waivers were issued across the nation as a result of hurricane Harvey and Irma. However, it’s not the time to reminiscence! You need to prepare to file by the deadline!

Important IFTA Reminders


IFTA Waivers

When the nation was struck by the major hurricanes Harvey and Irma, truckers we’re heavily depended on to deliver much-needed supplies to disaster areas. As a result, many regulations such as hours of service were temporarily lifted and many states issued IFTA and IRP waivers.

A few of these states include Tennessee, Iowa, Florida, Georgia, Illinois, New Jersey, Texas, Alabama, Indiana, Pennsylvania, West Virginia, Wisconsin, Florida, Maryland, Michigan, and more.

Under the IFTA waivers if you were hauling disaster relief supplies to impacted areas then you didn’t need your IFTA license or decals to travel through states that issued waivers. Also, each waiver varied depending on the state, but generally they were in effect for about 30 days.

For example, Georgia’s waiver started on September 12th and was written to last until October 8th or until the completion of hurricane relief efforts, depending on which came first. New Jersey's IFTA waiver began on September 8 and lasted until October 1.

These waivers did not affect the 3rd quarter IFTA deadline. Your IFTA return is still due by October 31st.

Required IFTA Information

Now just in case you need a little refreshing to complete your IFTA return you need to provide:

IFTA Qualified Motor Vehicle
Your vehicle qualifies for IFTA if:

  • Your vehicle is designed, used, or maintained for the transportation of people and property and
  • Has two axles and a gross vehicle weight of registered gross weight greater than 26,000 pounds, or
  • Has three or more axles regardless of weight, or 
  • Is used in combination when the resulting weight of the combination exceeds 26,000 pounds.

Avoid IFTA Penalties With ExpressIFTA

Alright, ladies and gentlemen! It’s time to get serious about tax deadlines because the 3rd quarter IFTA deadline on October 31st is almost here. That means you have about a week to file your IFTA return in time or you will have steep penalties to face!

To avoid IFTA penalties you will need to complete your return with your base jurisdiction by the deadline. In order to complete your return, you will need to report your fuel and distance records per jurisdiction. IFTA Late Filing Penalties

In most jurisdictions or states the penalty for filing late is a fee of $50 or 10% of the taxes due, depending on which amount is greater. However, in Nevada, the penalty for filing late is a $50 fee plus 10% of the taxes due.

Also, if you make a late payment in addition to the late filing fee you will be charged .4167% of the total tax due on a monthly basis until the total amount has been paid. Nevada ups the ante again by charging .4167% of the total amount due per month as well as a series of administrative fees.

The administrative fees equal $100 the first time, $500 the second time, $1,000 the third time, $1500 the fourth time, $2000 the fifth time, and $2500 every time after that.

HVUT Form 2290


HVUT or Heavy Vehicle Use Tax Form 2290 is the tax paid by those who operate heavy vehicles of 55,000 pounds or more on public highways. The taxes collected are used to fund construction, maintenance, and repairs.

Your Form HUVT deadline is based on the first month that you use your heavy vehicle during the tax period which runs from July 1 to June 30 of the following year. Your Form 2290 is due on the last day of the month following your vehicle’s first use month. Because most people first use their heavy vehicles in July their Form 2290 is due on August 31st.

Nontaxable Miles

Nontaxable miles include trip permit miles in all jurisdictions. When completing your IFTA return you are required to include fuel permit miles in the total miles section. However, you do not need to include these miles in the taxable miles for the jurisdiction that issues the permit.

Also, if you do not have an IFTA license you can get a temporary permit for the jurisdiction you need to travel in at one of your local DMV offices.

What About Toll Miles?

Toll miles or miles traveled on toll roads, are considered taxable miles and must be included on your return. Toll fees will not be included on your return as they are completely separate from fuel taxes. 

Exempt Miles

Exempt miles are used to calculate your MPG, but they are not used to calculate your taxable gallons. When completing your IFTA return you will see total miles and total taxable miles. That’s where you will include your calculated exempted miles. 

Taxable Miles

Taxable miles are the miles traveled by your qualifying vehicle(s) per jurisdiction. This does not include your nontaxable miles. Your nontaxable miles will be subtracted from your total taxable miles on your return. Also, your total taxable miles should never be greater than your total miles on your return.

7 Important IFTA Reminders

Do you ever get the feeling that you’re forgetting about something? Maybe you left your toothbrush back at the truck stop? Or maybe you left your coffee on the checkout counter? The mind is mysterious. Sometimes things slip and we just can’t quite put a finger on it.

With the 3rd quarter IFTA filing deadline being only a few weeks away on October 31st, there’s no time for mental lapses! You need to file by the deadline in order to avoid getting hit with major penalties. However, don’t stress about remembering every single detail when it comes to IFTA because ExpressIFTA is here to help! Check out our checklist of important things to remember!

7 Things To Remember About IFTA 


1. What is IFTA?

Before you file IFTA it’s important to know exactly what it is. IFTA is the International Fuel Tax Agreement. It was established to simplify the use of fuel by qualifying vehicles that travel in multiple jurisdictions (states) in the continental 48 United States and 10 Canadian provinces.

2. IFTA is Quarterly

Your IFTA return is due on a quarterly basis. That means you have to complete your IFTA return four times a year if you operate a qualifying vehicle in two or more jurisdictions. The IFTA deadlines include:

1st Quarter - April 30th
2nd Quarter - July 31st
3rd Quarter - October 31st
4th Quarter - January 31st

3. Don’t Forget About Your IRP Report

Just like with your IFTA report, you need to keep up with the miles your travel per jurisdiction for your IRP report. The amount you owe for your IRP tax is calculated by your mileage per jurisdiction. You can easily track your mileage for both IFTA and your IRP return with the help of ExpressIFTA.

Just keep in mind that you need your stamped Schedule 1 to complete your IRP return. That means you need to complete and pay for your HVUT Form 2290. ExpressTruckTax can help you quickly file and receive a copy of your stamped Schedule 1 via email within about 15 minutes.

4. IFTA Penalties

Don’t do the crime if you can’t pay the fine. Alright, so that doesn’t exactly rhyme, but you get the idea. If you fail to complete your IFTA return by the deadline you will have pricy penalties to face.

For example, if you fail to complete your IFTA fuel tax return by the deadline you will face a fee of $50 or 10% of the total tax due, depending on which is greater. Plus, a monthly fee of .4167% of the tax due will accrue until the amount is paid. On top of that, some states may even revoke your license for filing late! Also, Nevada imposes extra penalties on top of these!

National Tank Truck Carriers (NTTC) is an organization founded in 1945.
