The ELD Mandate Is Here

Today will be remembered as a major day in trucking history, as it is the ELD compliance deadline. Meaning that your trucks have to comply with the new regulations set forth by the FMCSA and this could have a major impact on trucking businesses.

As many drivers resisted the mandate and said they will quit if it took effect, all we can do is wait and see how the industry will be affected. Also, with ELD shortages across the nation, we hope you got your equipment already! So, what exactly does this mandate mean for you?

Today Is The ELD Compliance Deadline


Well, if you don’t have an ELD today, don’t panic. You won’t get parked, yet. The Commercial Safety Vehicle Alliance (CVSA) is giving drivers a grace period to comply, with their out-of-service-criteria (OOSC).

Under this criteria you have until April 1, 2018 to install an ELD that meets the FMCSA’s requirements before you will be placed out of service. However, starting today, December 18, roadside personnel and inspectors will begin checking rigs for ELDs and will issue citations at their own discretion for those who haven’t complied. That means if you don’t have an ELD you could get a warning or you could get an expensive citation.

If you have a grandfathered AOBRD or automatic onboard recording device installed before today and it meets the requirements of 49 CFR 319.15, you can continue to use it until December 16, 2019. Check out the ELD/AOBRD device Amil Freight has to offer if you still need equipment. They even provide helpful demos to teach you how to use it.

Many truckers focus on the negatives of getting an ELD device, but in reality, they can be quite helpful, especially when it comes to IFTA. You will be able to reduce paperwork as your ELD records all of your information for you.

Understanding IFTA and IRP Reporting

As a trucker, you have a lot of taxes to deal with. From your quarterly IFTA return to your IRP return, Heavy Vehicle Use Tax Form 2290, and more. Not only can these returns be confusing, but if you don’t comply with the IRS you could face hefty penalties or even get parked.

Understanding IFTA and IRP Tax Reporting

What is IRP?

IRP is the International Registration Plan. It’s a registration reciprocity agreement between the United States, District of Columbia, and provinces of Canada to provide payments of apportionable fees based on the total distance you operate in each jurisdiction (state).

You will have to keep track of the miles traveled per jurisdiction in order to renew your IRP plates. Your deadline varies based on the state your vehicle is registered in. The deadline can be found on your IRP card, which should be kept in your cab at all times.

In order to complete your IRP return, you have to provide a copy of your stamped Schedule 1. To do that head to ExpressTruckTax.com to instantly e-file your HVUT Form 2290, and as a result, you will receive your stamped Schedule 1 within about 15 minutes via email.

What is IFTA?

IFTA is the International Fuel Tax Agreement. It was put in place by the 48 contiguous states and 10 Canadian provinces in order to report on and redistribute fuel taxes used by qualifying vehicles that operate between at least two or more jurisdictions.

To comply with IFTA you will complete your return on a quarterly basis. Also, you will have an IFTA card to keep in your truck at all times, and you will be issued two IFTA decals that should be displayed on your driver door.

The following information is required to complete your IFTA return:
  • Total miles traveled per jurisdiction
  • Total gallons of fuel consumed per jurisdiction 
  • Total tax paid gallons of fuel purchased per jurisdiction 
  • And the current tax rate per jurisdiction 
Your Vehicle Qualifies for IFTA and IRP returns if it travels between two or more jurisdictions and has:
  • Two axles and a gross vehicle weight exceeding 26,000 pounds 
  • Two axles and a registered vehicle gross weight exceeding 26,000 pounds 
  • Three or more axles regardless of weight 
  • A combination weight exceeding 26,000 pounds.

Drivers are underpaid, treated poorly, and the lifestyle of being away from home is becoming unappealing. Companies need to step it up with better training, pay, and benefits to attract drivers and retain them.

3. Driver Health

Truckers are prone to smoking and unhealthy lifestyle habits that lead to major health issues. Truckers are obese, plagued with sleep apnea, have diabetes, are at risk for heart disease, strokes, heart attacks, and much more.

How To Improve Your Trucking Time Management

With the ongoing driver shortage, the trucking industry is facing the potential chaos that could occur as more and more drivers quit. It’s no secret that company drivers have an extremely high turnover rate. Plus, the ELD mandate that goes into effect December 18th could cause even more drivers to quit.

By improving time management skills and learning how to communicate with dispatchers both company drivers and owner-operators can increase their profit per mile and working conditions.

Effective Time Management For Truckers


One issue that truckers face with their hours is having too many unpaid hours. Generally, truckers are paid per mile, not by the hour. This means the hours spent waiting in traffic jams and for loads to be loaded and unloaded are unpaid.

This method encourages OTR drivers to drive as much as they can to increase their profits. Through methods of driving tired, forging paper logs, and more. Sometimes if they do stop to rest dispatchers may pressure them to drive more to increase production.

However, because truckers are only allowed to legally drive 11 hours a day these actions to increase production can be stopped. The ELD mandate will help enforce these hours and stop dispatchers from pushing drivers beyond their limits.

One of the ways to better manage your time is to plan your routes accordingly to find parking earlier in the day. You don’t want to be caught at the end of the day circling lots that have no space left.

If you park early you can get up early and beat the traffic. However, sometimes your parking solution can be as easy as learning what places along your route always have parking available and what places are always crowded.

It’s also smart to plan ahead for your routes. Try to schedule the most efficient stops and look at your routes on Google Maps. This will help you avoid going through city areas with a lot of traffic.

What Happens If You Don't Get An ELD

Despite the efforts to delay or completely get rid of the ELD mandate, it’s here to stay. As the compliance date ticks closer on December 18th we may see a new wave of heavy protesting to try and stop it, but you still need to prepare your trucks.

If you fail to comply with the ELD mandate you will have hefty fees and penalties to face. You could even be placed out of service! It will be much cheaper and easier in the long run to go ahead and purchase and install your ELD device. Check out the penalties you will face if you don’t comply with the ELD mandate.

Penalties For Failing To Comply With The ELD Mandate


Now you won’t instantly be shut down the moment the clock strikes 12:00 December 18th if you don’t have an ELD device. You will have a bit of a grace period implemented by the Commercial Vehicle Safety Alliance (CVSA).

The CVSA has created the out-of-service-criteria (OOSC) for the ELD mandate and has provided truckers with a little time to comply. However, this isn’t a free pass because beginning on December 18th inspectors and roadside personnel will begin checking and inspecting vehicles for compliant ELDs.

Then depending on the jurisdiction’s discretion if you don’t have a compliant ELD you may be issued a citation. The citation amount is also up the to jurisdiction's discretion and they could be quite substantial. Then on April 1, 2018 the OOSC associated with the ELD mandate will go into effect.

So, if you’re having trouble finding ELD hardware as fleets scramble to meet the compliance date, don’t worry. You have until the spring to comply before getting shut down. Although, it's really best to go ahead and comply to avoid citations.

Also, it’s important to remember that if your grandfathered automatic onboard recording device (AOBRD) that meets the requirements of 49 C.F.R. 395.15 then you can continue using it until December 16, 2019.

In the past when CVSA member jurisdictions implemented new mandates and regulations they noted that a phase-in approach was the best method of implementation. That’s why the CVSA Board of Directors, FMCSA, and motor carrier industry agreed to the phase-in approach with the ELD implementation.

Hopefully, this will simplify the transition to using ELD devices for commercial vehicle operators.

Will The ELD Mandate Effect IFTA?

IFTA For Beginners

Important IFTA Reminders


IFTA Waivers

When the nation was struck by the major hurricanes Harvey and Irma, truckers we’re heavily depended on to deliver much-needed supplies to disaster areas. As a result, many regulations such as hours of service were temporarily lifted and many states issued IFTA and IRP waivers.

A few of these states include Tennessee, Iowa, Florida, Georgia, Illinois, New Jersey, Texas, Alabama, Indiana, Pennsylvania, West Virginia, Wisconsin, Florida, Maryland, Michigan, and more.

Under the IFTA waivers if you were hauling disaster relief supplies to impacted areas then you didn’t need your IFTA license or decals to travel through states that issued waivers. Also, each waiver varied depending on the state, but generally they were in effect for about 30 days.

For example, Georgia’s waiver started on September 12th and was written to last until October 8th or until the completion of hurricane relief efforts, depending on which came first. New Jersey's IFTA waiver began on September 8 and lasted until October 1.

These waivers did not affect the 3rd quarter IFTA deadline. Your IFTA return is still due by October 31st.

Required IFTA Information

  • Has three or more axles regardless of weight, or 
  • Is used in combination when the resulting weight of the combination exceeds 26,000 pounds.

Alright, ladies and gentlemen! It’s time to get serious about tax deadlines because the 3rd quarter IFTA deadline on October 31st is almost here. That means you have about a week to file your IFTA return in time or you will have steep penalties to face!

To avoid IFTA penalties you will need to complete your return with your base jurisdiction by the deadline. In order to complete your return, you will need to report your fuel and distance records per jurisdiction. IFTA Late Filing Penalties

In most jurisdictions or states the penalty for filing late is a fee of $50 or 10% of the taxes due, depending on which amount is greater. However, in Nevada, the penalty for filing late is a $50 fee plus 10% of the taxes due.

Also, if you make a late payment in addition to the late filing fee you will be charged .4167% of the total tax due on a monthly basis until the total amount has been paid. Nevada ups the ante again by charging .4167% of the total amount due per month as well as a series of administrative fees.

The administrative fees equal $100 the first time, $500 the second time, $1,000 the third time, $1500 the fourth time, $2000 the fifth time, and $2500 every time after that.

Truck Tax Returns

IFTA


IFTA or the International Fuel Tax Agreement is a return that you need to complete on a quarterly basis. It’s used by the continental 48 United States and 10 Canadian provinces to simplify the reporting of fuel use by those who operate qualifying vehicles in more than one jurisdiction.

In order to complete your quarterly IFTA return, you need to report your fuel usage, purchases, and miles traveled per jurisdiction. You will also need to place two IFTA decals under the window of your driver side door and carry your IFTA license in your cab at all time.

The IFTA Deadlines are:

1st Quarter - April 30th
2nd Quarter - July 31st
3rd Quarter - October 31st
4th Quarter - January 31st.

HVUT Form 2290


HVUT or Heavy Vehicle Use Tax Form 2290 is the tax paid by those who operate heavy vehicles of 55,000 pounds or more on public highways. The taxes collected are used to fund construction, maintenance, and repairs.

Your Form HUVT deadline is based on the first month that you use your heavy vehicle during the tax period which runs from July 1 to June 30 of the following year. Your Form 2290 is due on the last day of the month following your vehicle’s first use month. Because most people first use their heavy vehicles in July their Form 2290 is due on August 31st.

Your IRP license allows you to travel in multiple jurisdictions. You will need to carry your IRP liscense in your cab at all times and you will have an IRP tag. You are required to complete your IRP return by the expiration date on your IRP tag.

You will need to report your miles traveled per jurisdiction and show proof that you completed Form 2290 and paid your HVUT tax to complete your IRP return. Your stamped Schedule 1 serves as proof.
